2. John Calvert Lawsuit

Dear Alan,

I thought the magic fraternity should know that on March 7, 2013, I filed a lawsuit in San Francisco Superior Court on behalf of John and Tammy Calvert against Randy Wolf, an Ohio physician. A copy of the Complaint is linked below. The Complaint alleges that in 2007 the Calverts contracted to sell Magicarama, their world famous magic show, to Defendant Wolf for $100,000.

Also, that the Calverts delivered the show to Defendant Wolf in 2008 and spent time teaching the show to Defendant Wolf and his family in California and elsewhere, but that after paying $37,000 towards the purchase price and keeping the show for two years, Defendant Wolf defaulted and refused to pay the remaining $63,000 to complete the purchase and would not return the show to the Calverts unless they returned the money he had paid them.

Besides Breach of Contract, the Complaint also alleges Financial Elder Abuse against Defendant Wolf for violation of the California Welfare & Institutions Code. To this day, Defendant Wolf still has the Magicarama show, although has only paid a fraction of the agreed upon purchase price.

We anticipate that the attorneys for Defendant Wolf will file a motion early on to object to his being sued in California. We will attempt to defeat any such motion by contending that Defendant Wolf had sufficient connections with the State of California during the operative time period so as to subject him to the jurisdiction of courts in California.

The Central City Association of Los Angeles named The Magic Castle as a Los Angeles Treasure during a luncheon at the Westin Bonaventure Hotel on May 9, 2013. Irene and Milt Larsen accepted the award on behalf of the club they founded along with Irene's husband and Milt's brother, Bill Larsen, Sr. Academy of Magical Arts Vice-president Erika Larsen was in attendance, as were Arlene Larsen, Rich Cowley (representing the AMA Board of Directors) and Joan Lawton (representing the AMA Board of Trustees).

Other honorees included Vin Scully (long-time "voice" of the L.A. Dodgers and the final home of the Shuttle Endeavor, the Los Angeles Science Museum. AMA Junior Program graduate Joel Ward delighted the1, 200 + crowd with a performance of "Metamorphis".

An illusion Criss Angel is staging on Fremont Street for television cameras today sounds extremely familiar to Riviera magician Jan Rouven.

A press release invites spectators to witness, and perhaps assist Angel with a "demonstration" at 10 p.m. in which Angel "will be chained to a wooden table with six nightmarish swords hanging high above him, with one fatally positioned over his heart.
"The audience will participate in the demo by picking the order in which swords will fall."

The German illusionist Rouven agrees it sounds a whole lot like a highlight of his ongoing show at the Riviera, in which an audience recruit chooses which swords fall one at a time around Rouven.

5. Remarkable Magic #301 - Nick Lewin

Agents, managers and other heroes and villains.

Last week I wrote some general thoughts on the various people you will work with as your career develops. I got some great responses from readers about my very simplified primer on this subject matter. This week I thought I would look at the general topic again from a less objective and more existential viewpoint.

The very first manager I worked with was a genial and smart man who was known as 'JP' to all his clients and friends. He received my press kit in the mail and was impressed that I had performed for members of the British Royal family. He saw this as a great selling point and it became an even bigger feature in my next press kit.

From 4-7 pm from Monday to Friday, 'JP' and his current group of confidants assembled in the bar of the French restaurant 'Maison Gerard' nestled in the shadow of Universal Studios. A lot of really great people were part of this floating 'happy hour' party and a lot of good business took place during these nightly sessions. I was pleased to discover that my new manager was improving my bookings substantially during this period. Yay.

Eventually the work slowed down, and my final gift from JP was in 1977 when he sold a murder mystery book I had co-edited called 'Sleight of Crime'. It turned out to be the start of a new career for 'JP', he moved to Chicago and became a very serious literary agent. He was a natural in the literary world and went on to sell many books and screenplays.

Many years later, I happened to meet up with one of my fellow acts from 'JP's' old client list, and they passed on his current phone number. When I phoned up 'JP' to say hi, he casually mentioned that during my years with him as a client his business had been a front for the CIA, who were utilizing him to spearhead an investigation into organized crime. Hmmm, who knew!

My next management experience was a big time deal, I was the 'pocket client' to a manager in one of Hollywood's top companies. Other clients included Linda Evans, William Shatner and Joan Collins. The Management contract netted me a great deal of money and introduced me to a strong publicist who did a great deal to promote my career. This was when my television career really took off.

The entire thing went to hell when my manager took my best friends live-in girlfriend out for breakfast and then by evening she had moved in with him. I ended up losing both a best friend and a great manager. Grrrr.

At a later time I experimented with hiring a publicist and an entertainment attorney to handle my career. This worked quite nicely but ultimately I needed an agency to bring in more leads. At this point I had a pretty high profile from my television dates and I signed with ICM, which was one of the two giant entertainment agencies. It should have worked great, however I quickly wished my friend's girlfriend had moved in with my agent instead of my manager.

I can't really say that ICM did anything much for me during our two-year contract, in fact I later discovered they had refused to consider or negotiate dates for me that I would have said yes to in a heartbeat. One thing that my responsible agent did do was to hook me up with my next manager. The new manager was the man who had represented Harry Blackstone Jr. and the idea was that we would continue along the agent/manager path that they had used to sell Harry. Hmmm, it didn't turn out that way.

I later discovered that the manager they had paired me with was worth less than zero to my career. He was charming, chatty and British - wait a minute, that's what I brought to the deal! Years later I discovered that I had been thrown to this particular manager because he had set up a deal for cheap roofing for three of the agents at ICM. Bastards.

I have also tried working with small boutique agencies, which in my case seemed to work out the very best. I think I can honestly say, I tried almost every variation that a resourceful performer could imagine. Sometimes it worked well, sometimes it didn't. The one thing I am convinced of is that it is the performer who needs to keep the ultimate overview needed for his career to flourish.

If the performer has a vision for the future, he needs to hire the people who can make it happen. Never forget that it is the performer who does the hiring; agents and managers like to make it appear that the reverse is true - it is not. The buck stops with the performer..

Isn't it a great feeling when you are at a gig and you alone had the ability to change a situation in your favor? We had this happen from time to time and it just always feels so good.

The most common is one of those gigs where the adults sit the kids down front and then go back to their seats to talk and gab during your performance. This can be anything from Birthday Parties to communion events banquet shows and the like. If you are doing family shows where there are kids and adults present, you are bound to see this happen a lot.

There seems to be this impression or perception that you are a "kiddie" magician and that the show is not for them and not geared for them. They feel that magic may be hokey and not very interesting. They also do not think for a minute that their talking and their noise level is rude. They seem to think it is expected because you are there to babysit the children.

It is annoying to come across this but we must realize that the perceptions are there and that is something we must combat ourselves if we want a successful show experience. My show is structured for total enjoyment from 3 to 103. If the show has adults and children present, my show is aimed at entertaining them all.

But if I do not handle this right, then I have a situation where by the noise of the adults prevents the children from hearing and causes major distractions for those who do want to watch. Why have to fight this in the first place?

When this happens, my wife and I make up our mind that it is not going to happen that way. We are not going to allow talkative and rude adults from impacting the success of the show. Now this does not mean that you combat rude behavior with rude actions. I am always a professional and there is a right and wrong way of how to handle it.

One of the best things you can do in situations like this, is to get the adults involved in the show early on. I do this right after my musical intro and my verbal introduction to the audience. We do an effect that is essentially audience manipulation without the audience realizing it.

My wife and I do a comedy tossed out deck routine. This works because of how we go about it. I want to immediately break down the wall between the stage and the audience. I want to cause the adults to focus on us and I do so in a very psychological manner.

My wife is the one who goes out into the audience to select 3 people at random. She is the one engaging the 3 helpers at their seats and having them select the card at random. Now the key is that we work the crowd. She picks a table on the right a table all the way in the back and a table on the left side. As this is happening, I am engaging the audience through patter stated from the stage area.

This works because the entire audience is seeing my wife walk through the crowd. The entire room is not only seeing the show but are becoming a part of it. The back table is always chosen to draw them in towards us. The 3 folks locations are important to us because not only are they involved, but the tables and people next to them become involved as well. They essentially are forced to watch and become engaged.

The routine is also very comical in nature with a lot of laughs and interactions. It is also a powerful trick to let the adults know that 1) this show is fun 2) we have skill that even they can appreciate and 3) it is a good time for them to pay attention because if I used them early in the show, I may use them and engage them again.

This is not to say you need to do tossed out deck. The key is any type of routine that you can engage the adults and interact directly with them early. Work the entire audience with whatever routine you choose. It works amazingly well and you will be impressed at just how fast the adults settle down and become a part of the experience.

The second day: We will again have the Magic Bazaar and lectures during the day. And people may also enjoy the swimming pool for some time. In the late afternoon we shall move to a THEATER for the Gala Show. And there will be again a Magic Bazaar for there may be new comers to our event from the center of the city.

In the Gala Show; some Turkish Performers as well as any international friends will perform. The priority to perform will be on the international friends for we will not have a chance to see them often around Turkey. The duration of their acts will be free for the visitors but will be limited to 10 minutes for the domestic performers. After the Gala Show we will move back to OBA Holiday Site where open stage and close up sessions will be carried with those who want to sleep late.

The third day: We will again begin with magic bazaar, lectures, workshops and seminars. We will have Open stage all day and towards midnight we will officially close the event. However we may continue with those who also want to stay longer.

Fee Strategy: Individual: 100 USD But may be waived if you are a member of IBM, IMS or the Magic Cafe.

Dealer's Table: 250 USD but may be paid in magic goods. If agreed in advance.

Other points to consider: - Every Attendant will pay for his own accommodation. There is a special fare for the participants for the hotel accommodation in OBA Hotel (Room Only). You may ask for a reservation and we will do it for you at no extra charge.

There is a wide variety of restaurants and food resources around.

The swimming Pool is free for the Hotel guests.

9. Broken Wand - Jose Zialcita

I received word that The Great Zialci died two days ago in Oregon USA. He was born 94 years ago in the Philippines as Jose Zialcita. A very big star in the days of vaudeville he appeared with all the big names of the era Pilita Corrales, Carmen Soriano, Dolphy, Elizabeth Ramsey, Panchito, Canuplin, etc. When vaudeville came to an end he made the transition into night clubs where he would perform throughout the world.

He was in the very first TV commercial ever made in the Philippines. His father had been the Philippine Ambassador to the United States and his mother a member of the Romauldez family clan of Leyte; being first cousin to the former First Lady of the Philippines Imelda R. Marcos. All the old time pros knew and loved Zialci--John Calvert, Johnny Aladdin, Paul Potassy, Ken Littlewood, etc. He was the subject of a very interesting book published several years ago in Manila. Zialci was a wonderful guy and lived many adventures. He will be missed.

This year's event will feature mentalist Richard Osterlind in a rare Florida appearance. Richard will be giving a fantastic lecture and he will perform in our Parlor Show as well. More recently the show packed out Adelaide Festival Centre and Queensland Performing Arts Centre, and will visit Auckland before a launching world tour from London's West End.

The hand-picked cast of internationally renowned illusionists together create a blockbuster stage show featuring a stunning mix of their most outrageous and unbelievable optical illusions including nail-biting Russian roulette, jaw-dropping acts of levitation, mind-reading, disappearance and escapes.

This show sees the magicians take their cue from the showmanship of the great illusionists of the past - such as Houdini - and combine it with contemporary sets, costume design, technology and live band Z, best known as touring band for Hip Hop legend NaS, to create a spell-binding family-friendly blockbuster. Creative Producer Simon Painter says the show is a world first, with each of the seven international illusionists the best in their niche and together creating a 21st century stage spectacular that will leave audiences spellbound.

"From Dan Sperry's shock illusions to comedy magician Jeff Hobson to Escapologist Andrew Basso who performs the Houdini inspired underwater escape live on stage, there is no other group of magicians who can deliver the mind-blowing entertainment that The Illusionists do at every show.
