The theatre is an intimate setting with 200 seats. Their award winning performance includes, NEW FOR 2006, a brand new illusion! That's right, an illusion never before performed. Here is the description: Jinger is hidden behind several pieces of a puzzle. The pieces are folded up, by Mark and formed to create a cube. Jinger has disappeared! Not so quick....Jinger's head appears from the top of the cube! The illusion is opened up and the audience can see through it. Mark makes one final fold of the box, and Jinger disappears completely. Copyright Ruling On Revealing Secrets Of Magicians -------------------------------------------- Message from Jack Straw Copyright Law U.S. Ninth Circuit Rejects Infringement Claim Based on Revealing Secrets of Magicians. In Rice v. Fox Broadcasting Co., No. 01-56582 (May 29, 2003), the U.S. Court of Appeals for the Ninth Circuit found that Fox Broadcasting did not infringe the copyright of Robert E. Rice, who claimed to have conceived the idea behind "Secrets Revealed," a Fox series of television specials (the Specials) developed from 1995-1997, which revealed the secrets behind famous magic illusions. Rice claimed that the Specials infringed his copyright in a 1986 home video for which he wrote the script, entitled The Mystery Magician. Noting that under copyright law, ideas generally do not receive protection, only the expression of such ideas do, the Ninth Circuit found that Rice's concept of revealing the secrets underlying magic tricks was too general in nature to warrant copyright protection. Under the doctrine of scenes a faire, expressions indispensable and naturally associated with the treatment of a given idea are treated like ideas and are therefore not protected by copyright. Therefore, while similarities in tangible expressive elements fall within the realm of Rices copyright and are pertinent to our analysis, the mere fact that both The Mystery Magician and the Specials reveal the secrets behind magic tricks does not by itself constitute infringement. Only if the Specials infringed upon the presentation and stylistic elements of The Mystery Magician could Rice state a claim for copyright infringement. Rice claimed that his Mystery Magician character -- a graphically illustrated masked magician "risking all" to expose secrets -- was subject to copyright protection in itself. The Ninth Circuit disagreed: Characters that have received copyright protection have displayed consistent, widely identifiable traits. See, e.g., Toho Co., Ltd. v. William Morrow and Co., Inc., 33 F. Supp. 2d 1206, 1215 (C.D. Cal. 1998) (Godzilla); Metro-Goldwyn-Mayer, Inc., 900 F. Supp. at 1297 (James Bond); Anderson v. Stallone, 1989 WL 206431, *7 (C.D. Cal. 1989) (Rocky Balboa). In contrast, the magician depicted in Rices work has appeared in only one home video that sold approximately 17,000 copies. Moreover, the magician is dressed in standard magician garb black tuxedo with tails, a white tuxedo shirt, a black bow tie, and a black cape with red liningand his role is limited to performing and revealing the magic tricks. Thus, we must reject Rices claim that the magician in his video is an especially distinct character differing from an ordinary magician in a manner that warrants copyright protection. Even though the court of appeals concluded that the magician in Rices work is not a separately protected character, the court of appeals still had to determine further whether the magicians in The Mystery Magician and the Specials are substantially similar. Although the two characters did wear masks, this was essentially the only manner in which to depict a magician risking ostracism by his profession by revealing trade secrets. Such physical similarities were insufficient grounds on which to base an infringement claim. -------------------------------------------- 4. From Magician To Speaker Part Nine -------------------------------------------- Message Quentin Reynolds A good opening establishes interest, authority and control. Think about the magic competitions you have experienced. How many magicians walk out and within nano-seconds, their manner and bearing convey they are both under-rehearsed and uncomfortable? How does that affect you as an audience member? It makes you uncomfortable in your seat and you're on edge because you know something is going to go wrong. You cannot relax and enjoy. Yet another magician can walk on and instantly you feel relaxed and comfortable. He exudes confidence and you don't care what journey he takes you on because you trust him. So most important - walk on with confidence. If you don't feel confident, then while backstage picture a time when you did feel really confident and let that mental image reflect in your body language as you walk on. Always remember people want you to be good. Nobody goes to a film, play or show wanting it to be less than excellent. Please do rehearse your talk. Proper rehearsal is the difference between a cheap off the peg suit and a hand made bespoke suit of the finest material. Having said that don't worry about being perfect the first time you give your talk to an audience. A hand made suit requires a number of fittings before it's just right! You closing should tie the whole talk together. It might refer back to something you said in your opening. It should reinforce your theme and the one point you want your audience to take away. Last week I promised to reveal what to do if you tell a funny story and it does not get the expected laugh. If you recall, the structure of your talk is: Dynamite opening which gets into the theme of the talk Make a point A story to illustrate the point Make a point A story to illustrate the point Make a point A story to illustrate the point. Wrap up and powerful close. It's very important to remember that the stories in a good talk are there to make a point, regardless of how entertaining they are. If your funny story gets no reaction simply say: "You're probably wondering why I told that story. Well the reason is"... and continue to make your point. A comedian can't use that tactic! Meetings with Remarkable Magicians #2 - Nick Lewin -------------------------------------------- Message from McCombical Meeting. I was sixteen years old and a very excited magician when I heard that Billy McComb was going to be performing, in my neck of the woods, in Sussex. I had seen him performing at the Conway Hall at one of the fabulous evenings that the London Society of Magicians sponsored. Now he was on my doorstop! In the 60's in England there were weekend events called 'Dinner Cabaret', where a good meal and several drinks were followed by a skilled entertainer. I phoned the owner of the club where Billy was playing and talked him into letting me enter the showroom and see the show, in spite of my tender years. That show was everything I hoped for and more. Sitting ringside in a room of maybe a hundred people I watched as Billy performed the strongest comedy and magic I have seen to this day. He halfway dyed his silk, put their coin in a bottle, restored that thread and finally did his classic ("I'll kill that cat") whiskey/egg bag routine. It is one thing to list tricks but it is quite another to cover the one liners, gags, asides and 'bits' that accompanied them. The show was one stretch of laughter from beginning to end, only punctuated by the powerful magic. Just like Bob Hope, there was a laugh every 30 seconds. In my opinion, only Billy's love of magic has prevented him from being one of England's top comedians. No sooner had the show finished then the Manager of the club came over to my table and said that Billy had heard there was a magician front of house and would I like to have a word. Would I ever, I couldn't believe my luck! Waiting for me at the bar, pipe in mouth and drink in hand was Billy, laughing and chatting with the barman. Billy, greeted me warmly, asked my name and led the way to a table where we could chat, and chat we did. We spent the next hour talking magic and all things magical. Best of all never once did he treat me as the obnoxious kid I was, but as an equal. He even taught me a trick, where a half crown stuck to his forehead, but when he passed it to me there was a sharp, blood red nail attached to the rear. I actually knew the trick but pretended that I didn't. After showing me his routine he said, "Here's the real secret!" and produced a cork that housed the coin safely and securely in his pocket between performances. Even then Billy was obsessed with not only the right trick but also the right way to travel it. When zip lock bags came out Billy was in seventh heaven. When Billy speaks I listen and to this day every trick in my working case is in a different zip lock bag with the contents listed on the front. After we had talked for an hour Billy said, "Well let's see about you coming back tomorrow, you should see my torn and restored card, the seven cornered hanky, the banknotes, etc. etc". I left in a happy daze, not quite believing my luck. The next evening I was treated to an almost totally different show. How cool was this, I couldn't believe it, he did a whole new show with entirely different tricks and jokes. After the show we met at the bar again and chatted far into the night. I was very proud that night when Billy took the time to talk to me and help me with my show. Now thirty plus years later I am even more amazed when I realize that it wasn't just me he treated this way, it's everyone along the way. Billy always takes time to talk, teach and help anyone with a love of magic. Always. Thanks Billy, not just from me, but all the others you have inspired and helped. Stars Of Tomorrow Show -------------------------------------------- Message from Hope Anderson The Stars of Tomorrow Show is a wonderful opportunity for young magicians ages 7-17 to perform at this summer's Society of American Magicians convention in Louisville, Kentucky, U.S.A. July 12-15. Please share this information with young magicians you know, and please help them work on their stage acts and apply for the show. The performers will be paid and will receive two free registrations for the convention (for the performer and a parent) and a year's membership in the Society of Young Magicians. To audition for the show, young magicians should submit a video or DVD of the stage act (about five to ten minutes in length) that they would like to perform in the show. The video or DVD does not have to be from an actual show or be professionally produced, but it should include the effects, music or patter, costume, and props that the magician would use if selected. More than one act may be submitted on an applicant's video. Young magicians interested in emceeing the show should also include a sample of introductions, jokes, and emcee bits on their videos. All applications should also contain the application form, a brief bio, and a photo that would be suitable for printing in the convention program. The deadline for receiving applications is April 20. Nick Lewin's Article Re: Conway Hall -------------------------------------------- Message from Peter Stammers (Cyprus) Nick Lewin's article re Conway Hall brings back memories - I could have been sitting in the audience next to Nick! I was in my teens and was a regular visitor to these events, organized I believe, by the London Society of Magician (LSM). Alfred Gabriel was the musical Director and as a member of the LSM, he had a very good magical act. Being a Tailor his act was called 'Made to Measure' and naturally, he dressed immaculate. I was on a number of shows with him via the Merlin Magical Society of which Edward Victor was the President. I had the pleasure, and honour of performing a manipulation act with Edward in the audience. Getting back to the LSM shows I can recall Maurice Fogel blowing away the magicians in the audience with a blindfolding routine. With his eyes covered and his back to the audience he described in detail objects held up by members in the audience. Many years later, I was told that Peter Sellars (of Pink Panther fame) was in the gods (top balcony) with a pair of binoculars and using his mimicking skills - he was Fogel's voice. Whether this is true or not - I don't know. Maybe others who remember the event and know different will let us know. I believe my source is reliable! -------------------------------------------- 8. Tom Hanks And Magic! -------------------------------------------- Message from Jack Straw 2006 is going to be known as the "year of magic in film". First Hugh Jackman and David Bowie in the Prestige. Then there is the possibility that "The War Magician" could get off the ground......then there is another one with Kate Winslett called something else... on and on. For sure, Tom Hanks will be bringing magic back to life with an appearance on the silver screen, playing a magician. According to Variety, the two-time Oscar winner and his actor son, Colin, are linking up for some hocus pocus on the big screen in the magician comedy The Great Buck Howard. The younger Hanks will play Buck, a wannabe magician who goes to work as an assistant to a celebrated conjurer whose career is in decline. The elder Hanks will take on the smaller role of Buck's father, whose not exactly thrilled about his son's job aspirations. Kevin Kline is in final talks to play the veteran illusionist and Buck's mentor. -------------------------------------------- 10. Wes Craven And Grand Guignol Magic Show In Vegas -------------------------------------------- Message from Jack Straw Different yes! As magicians look around them for the next Siegfried and Roy...wondering and wondering who that lucky star will be that takes the throne and crown of the legends of magic, S and R? Well a "new boy" is in town, meaning a new style of magic is in town. Out with the old, in with the new. I mean it is the new millennium, right. So finally a magic show in Vegas, since Siegfried and Roy, with a BIG BUDGET....and HORROR is the star of this magic show, NOT CATS! Called Wes Craven's Magick Macabre, the new show would combine blood, magic, scares, and spectacle, with designs and illusions from the creative talent behind Cirque du Soleil and Siegfried and Roy. The story is about a lowly magician who works for and is mistreated by the world's greatest magician. He makes a deal with the devil to take over his boss's job, but to do so he has to carry out tasks that wind up being the seven deadly sins. With each sin accomplished, he changes and becomes more and more like the original world's greatest magician... the one he murdered. The show is being shopped around by Craven, with the possibility of making it's new home at Steve Wynn's.....grand new hotel-casino! -------------------------------------------- 11. Gay Blackstone And NBC TV Project -------------------------------------------- Message from Jack Straw Gay Blackstone has recently filled the shoes of Dale Hindman at the Magic Castle, becoming President of this exclusive prestidigitators club. To start the term off, Gay was recently spotted (Tues. March 14 in the morning) supervising the auditions for the new Simon Cowell show. The TV show will air on NBC and will be based on American Idol, featuring "variety talents" like magicians. There is a possibility the winner will win a trip to Vegas! Yes...a free trip to Vegas? Not exactly a 3 day vacation....BUT yes, their own show! That is right some magician, or juggler or mime or marionette will be given their own show in Vegas IF they win on Simon Cowell's new show. Tues. the 14, magicians lined up at The Magic Castle in the morning auditioning for a coveted spot on this show. Rumor has it??? Sylvester the Jester was liked. Also several female magicians auditioned. Apparently, WANTED: A good-looking-sexy female illusionist. Not sure if they found her yet. Perhaps at Tues audition they did. The Magical Adventures Of Paul Romhany -------------------------------------------- Message from Paul Romhany (NZ) Just got home from a very busy time on three different cruise lines, my favorite by far was the classic ship the QE2. What a lovely ship and a great thrill to finally work one of the most famous cruise ships in the world. I left Australia and took it up to Japan on it's world voyage. The theatre was unusual in that you worked almost surrounded and there was a balcony right over top of you which meant people could see on top of you, but still it was a lovely experience. I am home for a few weeks before heading out again, working on 4 different ships again in 4 weeks, home for 2 days then out again. My agent certainly keeps me busy and it's great having this variety of cruise ships to work on. While home I am producing some amazing new videos from the creative mind of Andrew Gerard. Andrew has been a consultant for several top TV magicians and is now releasing his own incredible magic. ----------------- 16. The Amazing Orchante Saga ----------------- Message from Tommy Orchard (The Amazing Orchante)(UK ex-pat Kiwi) Page 92 Timaru strangeness - the band is spooked! IT does tend to rattle your nerves somewhat, when the lighting suddenly switches off when you're halfway up (or down) a flight of stairs, instantly plunging you into inky blackness - especially when a later inspection revealed that there was - NO 'EARTHLY' reason why it should have done so. It didn't matter whether you ran or sauntered up the stairs - the moment you got to the landing, OFF THEY WENT! Re-reading my description detailing the layout of the house, it seems on reflection, rather lengthy but I wanted you to be able to place yourself, metaphorically, in situation as I relate various incidents. I do tend to go into somewhat lengthy details at times. I'm told that it IS, a Virgo trait. When we first moved into the house we took the first bedroom on the left at the top the stairs, the Master Bedroom - firstly because the bathroom was right next door, followed by the toilet - and secondly, because it was enormous - with tons of room for furniture, beds etc. Over the first few nights we gradually became aware that something was 'NOT QUITE RIGHT' with the room - it was something you could feel - that something - a 'Presence', did not want you in there! On top of that, the room was always cold; even with the heating on full blast there was still a chill in the air, no matter if the outside temperature was hovering around 800F. All the other bedrooms - in fact the entire house was warm, except when you felt an indefinable eerie chill that 'something unseen' was following close behind as you walked either up or down the staircase to the landing; and it wasn't just at night either, but during the daylight hours as well! Finally, after a week or so, we couldn't stand it any longer so we packed our suitcases and belongings and moved - across the corridor to the bedroom that had access to the sunroom. The 'atmospheric' change was - pure tranquillity! Eddie Brooks rang to say that he had booked a five-piece band called 'PRENTICE' - billed as the 'North Island's No1 Group', for various hotel gigs in the South Island and the upcoming stage show/tour that he was setting up; would it be okay with us if they stayed at the house whenever they were in the area. Well, we could hardly refuse since Eddie was footing the bill, plus there were two spare bedrooms, and having five youngish musicians around could be fun - it was! When 'PRENTICE' arrived, we told them that they had the use of two bedrooms; they opted for the smaller bedroom, which was next to ours, to store their suitcases, guitars etc. and used the other, the master bedroom to sleep in because of its size. We did not mention the 'Not Nice' atmospheric conditions that we had encountered in that bedroom. A few days later, John Rarity - everybody called him 'Tangles', who was the drummer in the group said, "Have you noticed anything peculiar around here"? "What do you mean"? We said, " Well" he replied, " for one thing, the lights keep switching off when you're halfway up stairs", "Yeah, that's right" one of the other band members chipped in, "And you get this real spooky feeling that somebody is sneaking up behind you - makes the hairs on the back of my neck stand right up - IT'S BLOODY ##//***- FREAKY ", he said! IT SURE WAS! One day Veronica says to me "Come and look at this". She had been tidying up the boys' room - the one with 'The Presence' that was always cold; hanging up everywhere, pinned to the walls, over beds and around the windows were crucifixes - plus a string of garlic! Later, when we asked them about it they confessed that there 'was something' about the room that made them feel very uneasy. Actually it was Tangles who was much more sensitive to 'it' than the other band members although quite obviously, none of them were immune from - 'it'! Apparently, they had gone together to see the film, 'The Exorcist' when it was first released, back in 1973. Within half-an-hour Tangles had raced out from the theatre in quite an agitated state - frightened out of his wits, and headed for the nearest pub, poor sod. From what I can remember about the various newspaper reviews of the film at the time, he wasn't exactly on his own. Ever since then, he had been the brunt of many gags and all sorts of harmless stunts. Everybody used to congregate in the kitchenette, especially late at night when the band arrived back after a gig - for coffees, or a drink or two and a chat. It was also where Veronica had set up a table for her leather carving and sewing work (she called it her workroom), and had placed it against the door that led into the lounge room, which wasn't a problem as there was another door from the kitchen proper that led into the lounge. One evening I was sitting having a coffee while Veronica was carving a leather belt when the door that led into the main kitchen swung shut - probably a draft or something.
