2. Teller Wins Lawsuit Over Copied Magic Trick Performance

The silent half of Penn & Teller went to great lengths to pursue a Belgian entertainer who posted a copycat illusion on YouTube, and the case resulted in an entertaining ruling.

Teller is widely known as a great magician, but he has just pulled off a feat that is without equal among his peers. He has prevailed in a lawsuit against another magician who put up a copycat illusion on YouTube.

Technically speaking, magic tricks aren't copyrightable. In a ruling by a Nevada federal court on Thursday, U.S. District Judge James Mahan states that explicitly.

What is protectable under copyright law is pantomimes, the art of conveying emotions, actions and feelings by gestures. The theatrical medium where magicians work has some of the flavor of pantomimes, and Teller has used it to his advantage.

Teller's magic performance was called Shadows and is described as such:

"Shadows essentially consists of a spotlight trained on a bud vase containing a rose. The light falls in a manner that the shadow of the real rose is projected onto a white screen positioned some distance behind it. Teller then enters the otherwise still scene with a large knife and proceeds to use the knife to dramatically sever the leaves and petals of the rose's shadow on the screen slowly, one-by-one, whereupon the corresponding leaves of the real rose sitting in the vase fall to the ground, breaking from the stem at exactly the point where Teller cut the shadow projected on the screen behind it."

In 1983, Teller even registered Shadows with the U.S. Copyright Office in 1983. He included pictures:

Teller has been performing this trick for nearly four decades. Judge Mahan says there is substantial evidence that he is the creator. It's been an important part of his act and has had some mystique. Teller's partner, Penn Jillette, has publicly stated, "No one knows how Shadows is done, and no one will ever figure it out."
Well, another magician tried.

Belgian entertainer Gerard Dogge posted a YouTube video of an illusion called The Rose & Her Shadow and offered to reveal the secrets for $3,050. The caption on his video said, "I've seen the great Penn & Teller performing a similar trick, and now I'm very happy to share my version in a different and more impossible way for you."

That's what led to the lawsuit, and before it got to summary judgment ruling this week, Teller went to lengths to punish Dogge for copyright infringement.
Literally. Teller had to hire a private investigator to locate Dogge to serve papers to him, and for a while, Dogge evaded service in Belgium, Spain and other European countries. So Teller did a neat new trick. He emailed the court papers to Dogge and managed to convince the judge that his imitator had opened them. It was enough for the judge to allow the lawsuit to proceed.

Finally, Dogge put up a defense.

The defendant challenged the validity of the registration as a pantomime drama, but the judge waives such objection off.

"While Dogge is correct that magic tricks are not copyrightable, this does not mean that Shadows is not subject to copyright protection," writes Judge Mahan in his ruling. "Indeed, federal law directly holds 'dramatic works' as well as 'pantomimes' are subject to copyright protection, granting owners exclusive public performance rights. The mere fact that a dramatic work or pantomime includes a magic trick, or even that a particular illusion is its central feature does not render it devoid of copyright protection."

Dogge next tried to argue that in Jillette's pronouncement that "no one will ever figure it out," the statement was a challenge and an invitation for others to copy. But the judge reads what Jillette had to say carefully. "This statement merely provokes others to unearth the secret, not perform the work."

Among the other arguments was Dogge's insistence that his own trick wasn't substantially similar. The two versions both featured roses, screen projections and cut parts. Dogge, though, attempted to explain that his "secret to performing the illusion" differed from Teller's. This defense incites Judge Mahan to offer an incredible rebuttal.

"By arguing that the secret to his illusion is different than Teller's, Dogge implicitly argues about aspects of the performance that are not perceivable by the audience," he writes. "In discerning substantial similarity, the court compares only the observable elements of the works in question. Therefore, whether Dogge uses Teller's method, a technique known only by various holy men of the Himalayas, or even real magic is irrelevant, as the performances appear identical to an ordinary observer."
Magic!

The case now likely goes to trial on the question of what damages are to be awarded because the judge finds that Dogge has raised a genuine dispute of material fact whether he willfully infringed upon Teller's copyright. If a jury finds Dogge's misappropriation to be willful, Teller will be entitled to up to $150,000 in statutory damages. If not willful, Teller might get up to $30,000. Besides copyright, Teller also has an unfair competition claim, and the judge is throwing this to a jury as well to determine whether Dogge's YouTube videos were likely to cause confusion as to Teller's involvement with Dogge's commercial activity.

Teller is not the first magician to sue. See, for example, Robert Rice, aka The Mystery Magician, who sued Fox over its Breaking the Magician's Code specials, and wound up coming up short. Teller isn't the first magician to win one of these lawsuits either. See David Copperfield's lawsuit against a French magician who copied his flying routine. That case was in France, though.

Time will tell if other magicians attempt to follow in Teller's tracks in United States courtrooms. As the judge notes in the opinion, "Though there are organizations, taken seriously by many in the magic community, that blackball any performer who reveals a magician's secret, Teller has opted to pursue this action…"

4. Magic and Medicine Share a DNA

5. The White Tiger That Attacked Roy Show, Dies

Mantecore, the white tiger that attacked during Siegfried & Roy show, dies

(CNN) -- Mantecore, the white tiger whose co-starring role in Siegfried and Roy's illusion-packed Las Vegas act was overshadowed by one visceral act of violence, has died. The big cat was 17.

Mantecore died March 19, wrote Siegfried Fischbacher on the duo's Facebook page Tuesday.

The tiger had been living at the Siegfried & Roy Secret Garden and Dolphin Habitat at the Mirage hotel.

Mantecore was a part of the long-running "Siegfried & Roy" show when it lunged at Roy Horn's neck halfway through a sold-out performance in October 2003.
"He (Horn) looked like a rag doll in his mouth," an audience member told CNN at the time.

Trainers quickly rushed the stage to subdue the tiger. It was Horn's 59th birthday.
By the time emergency officials arrived, Horn had suffered massive blood loss and was in critical condition.

He also suffered a stroke and required two surgeries.

Four days after the attack, Fischbacher defended the tiger on CNN's "Larry King Live."

"Listen, I say it was an accident," he said, adding that if Mantecore wanted to kill his partner "it would (have happened) in no time."

Siegfried also said that Mantecore biting Horn's neck was similar to what a mother cat does with her cubs.

Horn did survive the attack, but was left partially paralyzed. He never returned to the stage and makes only rare public appearances. The show, too, was canceled.

In his post about Mantecore, Fischbacher wrote about the closeness he felt with the tiger.

Mantecore was one of three cubs. The cub's mother neglected it. So Fischbacher once had to go into the tiger's den and give it mouth-to-mouth resuscitation.

The young cub was then cared for by Fischbacher's mother, who bottle-fed it every three hours.

"Farewell my dear friend," Fischbacher wrote. "Know that your image is forever burned into my heart."

Five Magicians who amazed me.

In the second of my five lists of five I want to reminisce back to the five magicians who really blew me away when I watched them perform. These were my peak viewing experiences and are amongst a mere handful of such moments during my fifty years performing magic. I have tried to add a little hint as to what it was that made them all so special in my eyes.

Tony Slydini.
By far and away the most amazing experience I ever had as a magician was getting to sit down next to Tony Slydini as he performed and taught magic. It was in the late sixties in Ken Brooke's tiny magic studio on Wardour Street, in London. Seated with me at the table were Pat Page, Bobby Bernard and a couple of other magicians.

What was so amazing was the sheer impossibility of everything that Slydini performed. It was one of the few occasions when what I saw didn't look like tricks but truly appeared to be magic. A great deal is made of the fact that in order to perform Tony's magic you need to adopt some of his style and mannerisms to make it work. Unless you actually saw Slydini perform live it is easy to fail to appreciate how incredibly natural his movements and performance were when he did them.

Billy McComb.
The first time I saw Billy perform was at the Conway Hall in London and his act included 'The Half Dyed Silk,' 'The Gypsy Thread' and 'A Chicken Production.' I remember every trick almost fifty years later! What I remember most of all though was how incredibly funny he was. That was the amazing part about vintage McComb-the tricks were as strong as the comedy and combined together they were a blockbuster tour de force. Billy is still my hero.

Siegfried & Roy.
When I first saw Siegfried and Roy it was in their 'Beyond Belief' show at the Frontier Hotel in Las Vegas. I had just taped a 'Merv Griffin Show' at Caesars Palace and with a certain reluctance decided to catch their show. Why reluctance? Well I was no big fan of grand illusion (I'm still not) and thought their whole image was overblown and rather dumb. I also was no fan of the use of exotic animals in magic.

The dice were rather weighed against my enjoyment of the show and then to my delight I was charmed, astounded and delighted by what I saw. It was a truly amazing show and made me a fan for life; in fact I had to catch the show again just to make sure I wasn't imagining it. They performed a superb one-hour magic variety show and then just when you were ready to leave delighted, they did another thirty minutes of incredible non-stop magic. Truly 'Beyond Belief.'

Albert Goshman.
The first time I saw Albert perform in the Close-up Gallery at the Magic Castle I was in magical heaven. It was the amazing skill that his show involved coupled with a personality that was absolutely unique. It was just astounding the way those coins arrived under the salt shaker! Just as astounding was the brilliance with which he handled the two assistants who sat at the table with him. They were the ones who really 'sold' the magic but it was Albert who sold them!

Albert remains in my opinion the greatest master of misdirection I have ever seen, along with the late, great Jimmy Grippo. Sadly neither of these great artists were ever fully represented in video renditions of their work, as their misdirection just doesn't seem to gel in quite the right manner.

Ross Johnson.
I am a huge fan of Mentalism and I consider Ross to be one of the absolutely convincing practitioners in this field. I could have chosen Max Maven, Glenn Falkenstein, Jon Stetson or Maurice Fogel easily in this category but I decided to go with Ross because I honestly feel he is the most convincing mentalist I have ever witnessed.

I remember being spellbound the first time I watched Ross perform his classic Blindfold Act in a small nightclub. There was a slightly edgy sense of self-irritation in his performance that I just loved. If he didn't get it quite right, it seemed to bug him and drive him further into uncovering hidden details. He is truly a master of the wonderful world of mind reading.

Well that is this week's list, I thoroughly enjoyed the chance to re-think and re-live my first impressions of these master entertainers. Looking back at the list I realize that a key element is that they all really fooled me. I recently interviewed David Regal for an article and he stated that it was the real goal of every magician when watching a fellow magician to be fooled as a layman would. I think David is 100% correct!

Magic - Art, Craft or Neither? - Part 1 of 2
For me magic is both art and craft. The craft comes first and has to be technically flawless or the audience will see how an illusion or effect is done and that might spoil their experience-or delight them if they're sadistic and like to play "Gotcha, I saw how you did that."

"Craft" refers to skill, whereas "art" engages the senses and emotions and resonates with an audience. Craft is the loom upon which a magician can weave a tapestry of great beauty.

To use an example from my own background as a writer, when I took journalism classes in high school I was taught to give the general details in the first paragraph or two of a news story using the "5 Ws and an H" formula: who, what, when, where, why, and sometimes how. Then I could use consecutive paragraphs to add further details-more why and how-to expand upon the opening paragraphs. This is so an editor can shorten the story in the event that more space is needed for late-breaking news and still keep all the necessary information, which is right up front; readers won't miss anything important.

When I wrote "human interest stories," though, I still gave the facts, but could weave them throughout the story to set a mood and evoke the readers' emotions. These stories are more holistic and can't be shortened easily without losing some of the impact and the overall tone of the story; in the case of late-breaking news, they can be moved in their entirety to another day. Today these stories are called "creative non-fiction" or "literary non-fiction." They're more "artistic" than a straight news story.

So how does literary non-fiction relate to magic? Both the story and the magic effect begin with craft-basic rules or steps that have to be followed-or included-for writers or magicians to be successful. "Art" is how well writers engage their readers' interest and feelings, and how well magicians connect with an audience and stir people's curiosity, imagination, and emotions. Art transcends the moment, creates a memorable experience, and is subjective; the readers or people in the audience decide for themselves if a story or a performance was art for them.

12. Largest Annual Magic Auction In The U.S.

Magicians buy and sell new and used magic every moment of every day online via eBay, online magic auctions and through the social media. And occasionally there are the few physical auctions (such as Potter & Potter) that sell collectibles from magician's estates. We also see some magic going on the auction block at the occasional magic convention and magic club meeting.

But each year in Austin, Texas, nearly 300 magicians convene for a "mini-convention" for the express purpose of buying and selling some pretty great stuff. This week on The Magic Word Podcast, we talk with Trixie Bond, chairman of this this year's 33rd annual magic auction. Also on the podcast are the three, yes, three, auctioneers: David Hira, Grant Walsh and yours truly, Scott Wells.

This is not just a localized convention but can be attended online, too. If you cannot physically attend, you can see the items up for bid at their website and you can contact someone with your bid. Florida State 50th Anniversary Magic Convention Welcome Party
The Orlando, Florida State magic convention Welcome Party will take place, May 23 (Friday) 7:00pm-10:00pm in the huge Dealers' room.

A. In one corner of the room will be a small stage on which the Dealers will each have their 5 minutes of fame each presenting whatever "toy" they wish to promote.

B. The Dealers will all be lined up on one side of the room. We are expecting approx. 15 Dealers.

C. Opposite side of the room will be the entertainers, sitting behind a long table chatting with fans and signing the beautiful souvenir poster of the convention.

E. Center of room will have another long table displaying each of the 50 programs from the 50 years of Florida conventions.

F. Other side of the table will be raffle prizes, including a two night Orlando Hotel Resort stay as well as some magic goodies.

G. Circus gals (in beautiful tuxedo's) Amber & Ashley will be walking the room selling the raffle tickets.

H. During the party will be a card scaling contest for accuracy.

I. Our first lecturer of the conference, Billy Damon, will be hosting two balloon twisting contests.

J. Madame Karinthia will be in another corner reading palms and telling fortunes under her tent.

K. Stilt walkers and other various characters will be roaming the room (bring your camera).

L. A cash bar will be at hand.

M. Caricature artists Marvin & Marsh will be drawing your picture, no extra cost, first come-first serve.

N. Collector Phil Schwartz will have on display many of his beautiful original magic lithographs.

O. And here's the best part: You don't even have to attend the convention to be allowed in to the party! It's our "Thanks" to the Dealers.
