Teller Suing Dutch Magician Gerard Dogge --------------------------------------------- Message by Teller (US) By now you may have heard this over the grapevine, as it were, but I felt it important for you to have news directly from me as quickly as possible. You may be acquainted with my signature piece, "Shadows," in which I slash the shadow of a rose, and the actual leaves and petals fall where the shadow has been cut. It is the oldest piece in the active Penn & Teller repertoire, in continuous use in all our major runs from Broadway to international touring, to Las Vegas. It is an icon for our show and the piece I hope to be remembered by in magic history. I created "Shadows" in the mid-1970s, copyrighted it in 1983, and since then the magic community has shown me wonderful ethical support in allowing it to remain virtually untouched by copyists. Unfortunately, a few weeks ago, I was alerted to a YouTube video of a man (his name is Gerard Dogge, stage name Gerard Bakardy) selling equipment for emulating my piece. This was done without a single attempt to contact me, seek permission, or arrange a license agreement. I had my attorneys contact YouTube, and the videos were promptly taken down for copyright dispute. I contacted Gerard Bakardy/Dogge and let him know that my U.S. Copyright and E.U. Droit Moral entitled me to take legal action for what he had posted. I attempted to resolve the problem by discussion and negotiation, but he did not respond satisfactorily to that approach. This forced me to exercise my rights as copyright holder, and file for copyright infringement on April 11, 2012 in U.S. Federal Court. For your information, I include a copy of the legal documents below. I hope we will not have to add contributory and vicarious infringers in the action should third parties attempt to aid the infringer in selling his infringing product. Remarkable Magic. #30 - Nick Lewin -------------------------------------------- Message by Nick Lewin (US) How to learn to be funny. Now that is a provocative title for a column! The accepted answer is that you are either funny or you are not. I really can't disagree with that for the most part. However it is possible to learn about anything and comedy is no exception. Let's see if we can set up a few guidelines. First let me begin by saying that having a sense of humor really doesn't have very much to do with this process. I have met many fabulous comedians who haven't any discernible trace of humor when they are offstage. I won't say a majority of them, but you might well think so, if you didn't know the way the comedy mind works. A real comedian puts a great deal into his work and spends endless hours jotting ideas and line into little notebooks to experiment and dissect later. If you think perfecting your comedy timing is less difficult or time consuming than dealing a perfect center deal---YOU ARE WRONG. They both take a lifetime, both to get them right, and to keep them right. It is impossible to be truly funny just spouting of standard lines that you heard another magician get laughs with, or stuff you read in a joke book. You might get some laughs but it won't make you truly funny. In fact it will just get in the way and probably give you a false sense of confidence. Nothing really worth achieving arrives quite that painlessly. Sadly. Being funny requires a fully developed sense of self/persona that binds together the words you say into something that is truly unique. Watch Michael Finney, Paul Kozak, Amazing Jonathan, Mac King and other performers who really incorporate true comedy into their magic show. Notice how unique each one is in his attitude and approach. One of the reasons that this is the case is because each of these performers headlined on the highly competitive comedy circuit when it was at its zenith. We, I include myself, as I headlined the comedy circuit for 11 years, had the benefit of watching real comedians hone their craft. We had a chance to learn from them and with them. You learn magic by watching magicians and not comedians; you learn comedy by watching comedians not magicians. The previously mentioned performers (and two others) have transcended the scope of being categorized in any single mode. They really are funny. Watch the precision with which a comedian slices unnecessary words from his performance. It is like watching a brain surgeon carve the Thanksgiving Day turkey! See how they choose words with the care of a master chef choosing his ingredients for a special meal. Notice how, over time, a comedian will ruthlessly discard any joke that doesn't fit his particular character regardless of the laugh it gets. A good practice for someone who wants to be funny is to write down every word they are going to say onstage. EVERY SINGLE WORD. Then start to work on cutting words out and adding more laughs while doing so. Now this is a challenge that deserves all your active attention. Can you visualize whom you want the audience to see onstage and verbalize why they should think he/she is funny? It requires a great deal of hard continuous work. Is this work worthwhile? Well it is if you want to be funny, and the old saying is 'Funny is Money.' Generally speaking there are a greater number of higher paid comedians than magicians. I hate to burst anyone's bubble, but most audiences prefer to laugh than be fooled---it is just a fact. If you can be truly funny while fooling people then you won't have many empty dates in your datebook. Ask any of the performers I referenced! Be ruthless! Begin by cutting out anything that is really old or 'hack' in your act, fill the gaps this creates with original comedy that makes you into more of the person you want to be onstage. You don't always need jokes to be funny, sometimes they just get in the way, but you do need a clear vision of what it is that you feel can make you different/funny. Then work at it the way Charlie Miller worked at his bottom deal, and one day, just like that illusive sleight, it will just arrive. It won't be perfect at first; it will just be the raw gemstone that you can cut, polish and facet into a jewel that sparkles. Is it worth it? Wait until you experience the rush you experience when a real comic comes up to you and says, "Hey, you are funny." That is priceless! Fear of Cold-Calling - #254 - Kyle Peron -------------------------------------------- Message by Kyle Peron (US) magic4u02@aol.com http://www.kyleandkellymagic.com Have you ever tried cold-calling to try and land a show? Your heart starts to pound. You get all tense, dry mouth and you end up not knowing what to say or even how to say it. The nerves get shot and you end up fearing ever doing it again. But is this to say cold-calling is a bad thing? It really isn't. I think a lot of it rides in how you go about it. I have a vastly different approach to cold calling. I believe in active style marketing. In this fashion I am developing a lead list for the market I intend to target. Now as I am finding leads I can find them from a variety of sources. However, if I did a mailing or email campaign with this list, I will not get as high of a Return On Investment. The reason is that I am shooting in the dark. What happens is that I am not 100% sure that the person I am marketing to is the decision maker. That means the person who ultimately decides if I get booked or not. If I send to a lead list of contacts I just happened to find via internet searches etc., then I am wasting a lot of effort. In many cases the lead I may have found is actually what we refer to as a gatekeeper. This is a person that stands between you and the decision maker. The gatekeeper could be a secretary, receptionist or just about anyone. It is not their job to book you or even pass along your information. If you market to them, then it may be a wasted effort. So the idea here is to "qualify" your lead list. This means that you want to ensure that the leads you have found are accurate leads and the information is what you need for the decision maker. You want to confirm the decision makers contact information. By doing so, you have much more power and a much greater chance of landing a gig. So how does this tie into cold-calling? Well I use a cold-calling approach but I do not use cold-calling as a hard sell. I use cold-calling as a means in which to qualify my lead list. I use it to ensure that the information I have is accurate for the decision maker. If it is not, it is my goal to find out the accurate information and change it on my lead list I am generating. So when I call, I am being friendly and not spending or wasting a lot of time with the person on the other end. I do not want to waste their time or my own. My approach is to find out their name first. People become much friendlier towards you when you call them by name. So if my goal is to simply find out if my contact information is correct or not, then what do I say during my cold-calling approach? My script usually goes something like this: "Hi may I ask your name? I am not sure I heard it. Why thank you Amy. Amy my name is Kyle Peron and my wife and I are a husband and wife team specializing in family-friendly magic and illusion shows. I am calling as I got contact information in regards to the (such and such) festival event. I wanted to check with you if my information is correct. This way I can send them my information for possible consideration this year. Who I have is (state the name and info that I have on my lead list). Is that correct Amy or is there a better person handling entertainment this year? Why thank you so very much for that information as it is most appreciated. You have a wonderful day, Amy." That is pretty much it. I am not hard selling to them at all. If you notice I am polite in my approach and my goal is that I am calling not to sell but to confirm information I have received. This is a much better approach. In the mind of the person I am calling, they can often assume I got the information from their organization itself and perhaps I am calling just to verify what I have is right. My friendly and direct approach gets right to the point and they usually have no problems at all with assisting me in either confirming my contact information or helping me to fix it with the proper info. Now the beauty of this approach is that not only am I using cold-calling in a very unique and powerful way, but I now have a name that I can use when I do my marketing. If the person I talked to is NOT the decision maker, I can state that I had talked to Amy and Amy suggested I contact you in regards to the event you are hosting this year. A person is much more apt to read your information if they know that you are coming to them from someone they already know. The other power in this cold-calling approach is that the person you call may indeed be the decision maker. However, because I am not hard selling and simply asking to verify info. they usually will always state that they are the ones who decides on the talent. This then opens you up more to a conversation with them. You now can engage them in the sell but THEY initiated it and not yourself. So utilize this approach when you are doing a cold-call and you will see a much greater success and return on your next marketing. As always, I encourage you the readers to let me know your thoughts. JP: Yes. Those were exciting times . The late Howard Peters asked me to use my 11 foot guillotine to decapitate Bob Danvers Walker. This was the one which was used by Tommy Cooper in the Parkinson Show, and eventually I became Magical Consultant to some of The Tommy Cooper Shows. Through Ali Bongo I got involved with The David Nixon shows and during that time I built over 40 Illusions and effects for the show. Deputising for Ali Bongo as consultant for a six week series recorded for Television at The Theatre Royal Nottingham for a show that was called "Summer Royal" fronted by Bernie Clifton with Guest artists, Anita Harris, Frankie Howard, Larry Grayson, Bobby Crush, with Noel Gordon and Sue Pollard being the regular weekly artists. Making Special effects for The Basil Brush Shows and Little & Large. John Fisher, when he was working for the BBC, invited me to provide some props for The Paul Daniels Show which he was then Producing. When John moved to Thames Television to take on the post of Head of Light Entertainment, I worked for him on The Best of Magic Series, The Magic Comedy Hour, and then together with John Wade as Joint Magical Advisers for The Magic Comedy Strip. ADB: You also had a challenge or two .. JP: Did I ever??? Ha! Ha! One of the biggest challenges I had, was to supply the props for Mickey Mouse's Magic Shop for the programme "The Magic of Euro-Disney" also I made two illusions for Harry Blackstone who was fronting the programme. Columbus MAGI-FEST Is Closing Its Doors -------------------------------------------- Message by Jep Hostetler, Former Director of the MAGI-FEST Dear Friends: The Columbus MAGI-FEST has had a great run of 80 years (81 conventions). And while we hoped to see the 100th, for now we've decided it's time to retire the convention. This decision did not come easily; there were several factors. The Redcoats have a strong friendship-we are like a second family to each other. We've all watched our kids (and even some grandkids) grow up at MAGI-FEST, and we thank you for being a part of their lives and for the wonder that we and they got to experience these many years. We finished the convention in the black, able to pay all our bills and refund money to those who pre-registered for 2013. While we wanted to have our 82nd convention in 2013, we decided to change those plans after further reflection. We see some potential headwinds that could affect the quality and financial health of future conventions. These include: Long-time, loyal attendees who are aging out faster than younger registrants are coming in, The downturn in the economy over the past few years, Financial pressure on the convention due to increasing costs and insurance requirements, while keeping registration, food, and lodging costs affordable to attendees. We are all very sad to retire MAGI-FEST, but we want to do so on our terms as a quality, family-friendly convention, at an affordable price, that was fair to all who participated. We also wish to thank our wonderful staff: Tony Dolciato, Randal Fath, Mike Heniken, Steven Kline, the Krech kids, Glenn Mackie, Red Penley, and Mike Sanderson. We appreciate their tireless dedication and support more than they know. They are the ones who made it happen at "show time".
